Decree on May 21, 1999

Recognition of the denomination of controlled origin of the wine "Capalbio" and the approval of the relative production disciplinary.

The executive head of administration of the National Committee for the protection and valorization of the denominations of origin and of the typical geographical wine indications and the responsible of the procedure; Following to the Presidential decree on July 12, 1963, n.930 that contains the norms for the protection of the denominations of wine origin; Following to the law on February 10, 1992, n. 164, that refers to the new disciplinary on the denominations of wine origin; Following to the Presidential decree on April 20, 1994, n. 348, with which a regulation concerning the recognition procudere of the denominations of wine origin got enacted; Following to the decrees of realization issued by the above mentioned law; Following to the law on June 16, 1998, n. 193 that refers to the modification of art. 7 of the law on February 10, 1992, n. 164; Following to the intense effort aiming at the recognition of the denomination of controlled origin "Capalbio" , presented by Federazione provinciale Coldiretti Grosseto, by Confederaione italiana agricoltori Grosseto and by Confagricoltura unione provinciale agricoltori Grosseto, by the provincial administration of Grosseto and completed by the opinion of the Regione Toscana; Following to the positive opinion of the National Committee for the protection and the valorization of the denominations of origin and the typical geographical wine indications about the above discussed query and the proposal of the relative production disciplinary of wines with the appellation denomination of controlled origin "Capalbio", issued in Gazzetta Ufficiale n.63 on March 17, 1999; Considering as necessity to proceed to the recognition of the denomination of controlled origin "Capalbio" and to the approval of relative production disciplinary of the wines in concern, in conformity with the opinion expressed and the proposal formulated by the above mentioned Committee; Considering that the art. 4 of the regulation on April 20, 1994, n. 348 that concerns the recognition procedure of the denomination of controlled origin and the approval of the production disciplinary provides that the production disciplinary gets approved and recognized by the decree of the head responsible of procedure;

Declares:

Art. 1.
The denomination of controlled origin "Capalbio" is recognized and the production disciplinary is approved by the present decree. The denomination of controlled origin "Capalbio" is reserved for wines that meet the conditions and requirements stipulated in the production disciplinary that enters into force starting from the harvest of 1999.

Art. 2.
Those who intend to release for the market, starting from the harvest of 1999, the wines with appellation of denomination of controlled origin "Capalbio", are obliged to declare the vineyards' surface, until sixty days of publishing this decree, according to the art.15 of the law on February 10, 1992, n. 164, that refers to the relative norms of vineyards' register and grapes declaration.

Art. 3.
The vineyards declared in conformity with the previous art. 2, valid only for the year of 1999, can be temporarily signed in register as stipulated in the art. 15 of the law on February 10, 1992, n. 164, if the technical body of the Tuscan region judges their documentations as sufficient. This holds if for any technical reason the verification of the capacity foreseen in the current regulation has not been performed yet.
